1. Acceptance of Terms
By downloading or using Sympto ("App"), you agree to these Terms. If you do not agree, do not use the App.
2. MEDICAL DISCLAIMER
Sympto is NOT a medical device, and we are NOT doctors.
- Informational Only: The insights, patterns, and "correlations" shown in the App are for self-reflection and informational purposes only. They are not medical diagnoses.
- No Professional Advice: The App does not provide medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay in seeking it because of something you have read in the App.
- Emergency: If you think you may have a medical emergency, call your doctor or emergency services immediately.
By using Sympto, you acknowledge that you are solely responsible for your own health decisions.
3. Description of Service
Sympto is a voice-powered wellness journal. It uses Artificial Intelligence (AI) to transcribe voice notes and identify potential patterns in your lifestyle data.
- AI Limitations: You acknowledge that AI is not perfect. Transcription errors may occur. The "Insights" generated are probabilistic suggestions, not absolute facts. You should always verify the data in your logs.
4. User Accounts
Anonymous Use: You may use the App without an email address. If you lose your device or delete the App, your data cannot be recovered.
Account-Based Use: If you create an account, you are responsible for maintaining the security of your login credentials. You agree not to share your account with others.
5. Subscriptions and Payments
Sympto offers a free tier with limited functionality and a paid subscription ("Sympto Pro") that unlocks additional features.
- Free Tier: Includes up to 50 voice or text log entries. After the free limit is reached, a Sympto Pro subscription is required to continue logging.
- Sympto Pro Monthly: $3.99 USD per month.
- Sympto Pro Annual: $24.99 USD per year.
- Free Trial: Sympto Pro may include a 7-day free trial. If you do not cancel before the trial ends, you will be automatically charged the subscription price.
- Payment: Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- Managing Subscriptions: You can manage or cancel your subscription at any time through your device's App Store account settings (Settings → Apple ID → Subscriptions).
- Price Changes: We may change subscription prices from time to time. Any price change will take effect at the start of the next subscription period following the date of the price change. If you do not agree with a price change, you may cancel before it takes effect.
- Refunds: All purchases are processed by Apple. Refund requests must be submitted through Apple's support at reportaproblem.apple.com.
6. Voice Data and AI Processing
- Transcription: When you use the voice logging feature, your audio is sent to a secure third-party speech-to-text service for transcription.
- Analysis: The transcribed text is processed by AI to extract structured health data (foods, symptoms, severity, timing).
- Data Minimization: Unless you explicitly enable audio storage in Settings, raw voice recordings are deleted immediately after transcription.
- No Human Review: Your voice recordings and health logs are not reviewed by Sympto employees unless you explicitly report a bug and provide consent.
7. Your Content
You retain ownership of all data you input into Sympto. We do not claim any intellectual property rights over your health logs, notes, or exported reports.
You grant Sympto a limited license to process your data solely for the purpose of providing the service (transcription, pattern analysis, report generation).
8. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers or networks
- Use the App to store data on behalf of third parties without their consent
9. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately. If you have a paid subscription, cancellation of the subscription does not entitle you to a refund for the current billing period.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated insights may contain inaccuracies.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMPTO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
